FARGO, N.D. (Valley News Live) - UPDATE: A Fargo man has taken a plea deal and been sentenced after he hit and killed his girlfriend’s Pomeranian dog earlier this spring.

29-year-old Khiry Juan Hill was originally charged with one count of felony animal cruelty, but the charge was amended to a misdemeanor count of animal abuse in court Monday morning.

Court documents state Hill became upset with the dog because it was eating his food. Two children, who were witnesses to the incident, told investigators that Hill hit the dog with his hand, which caused the dog to hit a wall in the living room.

When Hill’s girlfriend arrived home, documents say Hill threw the dog at her and told her to ‘take her to the vet.’ Documents say the dog appeared stiff and lifeless. A veterinarian later told the woman the dog had severe bleeding in its lungs and no heartbeat.

A Cass County judge sentenced Hill to 360 days in jail, with credit for the 205 days he’s already served, as well as one year of unsupervised probation. Court records state Hill will also have to pay restitution to his now ex-girlfriend totaling over $1,700.
